Terms of Service
Welcome to Fabubath. This website is operated by Fabubath, a DBA (Doing Business As) of Cabinet Expo. Throughout this website, the terms “Fabubath,” “we,” “us,” and “our” refer to the business operating under the Fabubath trade name.
These Terms of Service govern your use of our website, online store, products, services, and related features.
By accessing our website, placing an order, or purchasing a product from Fabubath, you agree to these Terms of Service, together with our Return & Refund Policy, Shipping & Delivery Policy, Privacy Policy, and other policies referenced on this website.
Please review these Terms carefully before placing an order.
1. Online Store Terms
By using this website or purchasing from Fabubath, you represent that you are at least the age of majority in your state or jurisdiction of residence or otherwise have legal authority to enter into a binding agreement.
You may not use our website, products, or services for any unlawful, fraudulent, or unauthorized purpose.
We reserve the right to refuse service, restrict access, or cancel transactions where reasonably necessary to prevent fraud, misuse, unauthorized activity, pricing errors, or violations of these Terms, subject to applicable law.
2. Product Information, Images & Specifications
Fabubath makes reasonable efforts to accurately present product descriptions, photographs, dimensions, finishes, colors, materials, specifications, configurations, and other product information.
However, bathroom furniture and related products may contain natural or manufacturing variations.
Natural wood, wood veneers, engineered wood, natural stone, quartz, cultured marble, and similar materials may vary in color, grain, texture, pattern, veining, surface appearance, and manufacturing batch.
Product appearance may also vary because of photography, lighting conditions, screen settings, and display devices.
Reasonable variations inherent to these materials are not necessarily manufacturing defects.
Dimensions and specifications may be subject to reasonable manufacturing tolerances.
Customers are responsible for confirming product dimensions, plumbing locations, clearances, specifications, finish selections, and compatibility with their project before ordering and installation.
Product Configurations
Certain products offer customizable selections, including countertop materials, sink configurations, faucet-hole options, hardware finishes, and other product features.
Customers are responsible for reviewing their selected configurations before completing checkout.
The configuration recorded in the order confirmation will be used to process the order, subject to availability and any corrections agreed upon with the customer.
If a product materially differs from its advertised specifications or the customer's confirmed order, applicable consumer remedies remain available.
3. Pricing & Payment
All prices are stated in U.S. dollars unless otherwise indicated.
Prices do not include applicable sales taxes, optional services, installation, or other charges unless expressly stated.
Fabubath currently offers free standard shipping to eligible California delivery addresses under its Shipping & Delivery Policy.
Applicable sales taxes and any authorized additional charges will be displayed or disclosed as required before the customer completes the purchase.
Fabubath reserves the right to correct typographical errors, pricing errors, promotional errors, inaccurate specifications, or other obvious mistakes.
If an error affects an order that has already been submitted, Fabubath may contact the customer with corrected information and offer the option to proceed with or cancel the affected order.
Payment Authorization and Capture
For supported payment methods, payment may be authorized when an order is placed and captured after Fabubath verifies product availability and determines that the order can proceed.
Payment authorization does not necessarily mean that funds have been collected.
Authorization periods vary by payment provider and payment method. If an authorization expires before payment is captured, additional payment authorization may be required.
Some payment methods may process charges differently, and the applicable payment process will be governed by the payment provider and checkout disclosures.
Fabubath will not intentionally capture payment for merchandise confirmed to be unavailable without providing the customer with appropriate fulfillment or cancellation options.
4. Orders & Order Acceptance
Submitting an order does not automatically constitute final acceptance by Fabubath.
Orders are subject to verification of product availability, selected configurations, payment authorization, delivery eligibility, and other fulfillment requirements.
We reserve the right to decline or cancel an order for legitimate business reasons, including:
-
Product or supplier unavailability.
-
Incorrect pricing or product information.
-
Payment authorization problems.
-
Suspected fraud or unauthorized transactions.
-
Shipping restrictions.
-
Inability to fulfill the selected product configuration.
-
Other circumstances preventing reasonable fulfillment.
If Fabubath cancels an order after payment has been collected and before fulfillment, the applicable payment will be refunded in accordance with applicable law.
Customers agree to provide accurate and complete billing, shipping, contact, and payment information.
Fabubath may contact customers to verify information necessary to process their orders.
5. Shipping & Delivery
Fabubath currently accepts online orders for delivery within California only.
Eligible online orders receive free standard shipping, with no minimum purchase requirement.
Our estimated delivery timeframe is 7–14 calendar days from the date an order is placed, depending on product availability, supplier processing, destination, and transportation scheduling.
Delivery timeframes are estimates and are not guaranteed delivery dates.
Delivery may be affected by warehouse processing, manufacturer availability, carrier schedules, weather, transportation disruptions, holidays, natural disasters, labor disruptions, and other circumstances outside Fabubath's reasonable control.
Customers will receive information regarding significant anticipated shipping delays and their applicable cancellation or refund options in accordance with law.
Freight Delivery
Large bathroom vanities, countertops, and other oversized merchandise are generally delivered by specialized freight carriers.
Unless expressly stated otherwise, standard freight delivery includes:
-
Curbside delivery.
-
Liftgate unloading.
-
A standard delivery attempt.
-
Coordination of a delivery appointment, where applicable.
Curbside delivery does not include placement inside the home, garage, bathroom, upstairs areas, or other interior locations.
Installation, unpacking, assembly, plumbing connections, and packaging removal are not included unless expressly stated.
Freight deliveries may require a scheduled appointment and an adult authorized to receive and inspect the shipment.
Customers are responsible for providing accurate contact and delivery information and informing Fabubath of any restrictions affecting reasonable carrier access.
Additional optional delivery arrangements and related charges will be discussed and require customer approval before being arranged.
Further details are provided in our Shipping & Delivery Policy.
6. Delivery Inspection & Freight Damage
Customers should inspect all shipments promptly upon delivery.
Before signing a freight carrier's delivery receipt or Bill of Lading, customers should inspect the pallet and exterior packaging for visible damage whenever safe and reasonably possible.
Visible damage should be photographed and clearly noted on the carrier's delivery paperwork.
After delivery, customers should carefully unpack and inspect all components for concealed damage, missing items, defects, or incorrect merchandise.
Important: 48-Hour Inspection and Reporting
Customers should thoroughly inspect their complete order as soon as possible, and no later than 48 hours after delivery.
Shipping damage, concealed damage, missing components, defects, or incorrect merchandise should be reported promptly to Fabubath, preferably within 48 hours of delivery.
Prompt reporting assists Fabubath in documenting the condition of the merchandise and meeting applicable freight carrier and supplier claim deadlines.
Reports submitted after 48 hours will be reviewed individually. This requested reporting timeframe does not automatically eliminate rights or remedies available under applicable consumer protection or warranty laws.
Original Packaging and Wooden Pallet
Customers should preserve all original packaging and the wooden shipping pallet.
Original cartons, foam, protective wrapping, corner protectors, shipping labels, and the pallet should not be unnecessarily torn, damaged, or discarded.
Packaging and pallets may be required for freight inspections, damage claims, returns, or replacement shipments.
Customers should retain these materials until the entire order has been inspected and Fabubath confirms they are no longer needed.
A product that appears damaged, defective, incomplete, or incorrect should not be installed, modified, drilled, assembled, or connected to plumbing before contacting Fabubath.
Claims involving damaged, defective, missing, or incorrect merchandise are handled in accordance with our Return & Refund Policy and applicable law.
7. Returns, Refunds & Cancellations
Returns, refunds, voluntary exchanges, cancellations, refused deliveries, and freight-related claims are governed by Fabubath's published Return & Refund Policy.
For eligible voluntary returns, our standard terms include:
-
14 calendar days from delivery to request return authorization.
-
A 20% restocking fee calculated on the returned merchandise price before sales tax.
-
Customer responsibility for voluntary return freight charges.
-
Return of unused, uninstalled, and unmodified merchandise in accordance with the published eligibility conditions.
-
Preservation of original packaging and appropriate palletized shipping materials.
-
Written return authorization before merchandise is shipped back.
-
No direct voluntary product exchanges.
Certain products expressly identified as Final Sale or nonreturnable before purchase may be excluded from voluntary returns, subject to applicable law.
Damaged or Defective Products
The standard voluntary-return restocking fee does not apply to verified qualifying defects, shipping damage, or fulfillment errors attributable to Fabubath.
These situations are handled separately under the applicable damage, warranty, and consumer protection procedures.
Order Cancellations
Orders may generally be canceled without charge before Fabubath places the supplier order or otherwise commits the merchandise to fulfillment.
After supplier processing begins, cancellation may depend on the order's status and applicable disclosed conditions.
Once an order has shipped, a customer-requested cancellation may need to be handled under the voluntary return policy.
No unspecified cancellation fee will be imposed.
Nothing in this section restricts statutory cancellation, refund, or other consumer rights.
Customers should review the complete Return & Refund Policy before purchasing.
8. Manufacturer Warranties
Fabubath sells products manufactured by multiple independent manufacturers and suppliers.
Warranty coverage varies by manufacturer, product, and collection.
Where a product is covered by a manufacturer's warranty, the applicable manufacturer's warranty terms—including its duration, coverage, exclusions, claim requirements, and remedies—apply to that product.
Fabubath does not replace or modify a manufacturer's warranty unless Fabubath expressly provides a separate written warranty for a particular product.
Depending on the manufacturer and warranty terms, warranty remedies may include replacement parts, repair, replacement of defective components, replacement of the product, or another appropriate remedy.
Fabubath will reasonably assist customers with applicable manufacturer warranty claims when appropriate, including communicating with the manufacturer or supplier when the claim process requires submission through an authorized retailer.
Proof of purchase, photographs, product information, serial or model information, and other documentation may be required.
Manufacturer warranties generally do not cover damage resulting from improper installation, misuse, abuse, improper maintenance, unauthorized modifications, accidents, improper plumbing connections, chemical exposure, normal wear, or other conditions excluded by the applicable manufacturer's warranty.
Warranty coverage does not necessarily include labor, removal, installation, reinstallation, plumbing, contractor expenses, project delays, or other consequential costs unless expressly included in the applicable manufacturer's warranty or required by law.
Manufacturer warranty terms do not displace any non-waivable obligations or consumer remedies that apply to Fabubath as the seller.
9. Installation & Measurements
Unless expressly included in a particular transaction, Fabubath sells products and does not provide installation as part of the product purchase.
Customers are responsible for ensuring that products are properly installed and that installation complies with applicable building, plumbing, electrical, and other requirements.
We strongly recommend verifying all dimensions, plumbing locations, clearances, countertop configurations, sink locations, and other relevant specifications before ordering and again before installation.
Fabubath is not responsible for damage resulting from improper installation, unauthorized modification, misuse, improper maintenance, incorrect plumbing connections, or failure to follow applicable manufacturer instructions, except where otherwise required by law.
Do not install a product until it has been inspected and confirmed to be the correct product, size, finish, configuration, and condition.
Installation or modification of a product after an apparent defect, damage, or incorrect configuration has been discovered may affect available voluntary return, freight-claim, or warranty remedies, subject to applicable law.
10. Project & Installation Costs
Unless otherwise required by applicable law or expressly agreed to in writing, Fabubath is not responsible for contractor charges, plumbing charges, installation or reinstallation expenses, demolition costs, lost labor time, project delays, temporary accommodations, or other project-related expenses resulting from delivery delays, product replacement, warranty service, or product availability.
Customers and contractors should not schedule installation until merchandise has been delivered, thoroughly inspected, and confirmed to be complete and in acceptable condition.
Nothing in this section excludes liability or remedies that cannot legally be limited.
11. Third-Party Services
Certain payment processors, financing providers, freight carriers, manufacturers, suppliers, and other services used in connection with Fabubath orders are operated by independent third parties.
Those services may be subject to separate terms and conditions.
Fabubath is not responsible for independent third-party acts or omissions except to the extent responsibility cannot legally be excluded.
This provision does not eliminate Fabubath's applicable obligations to customers as the seller of merchandise.
12. Intellectual Property
Fabubath-owned website content, including original text, graphics, layouts, logos, photographs, designs, and other materials, is protected by applicable intellectual-property laws.
Manufacturer names, trademarks, photographs, logos, product designs, and other manufacturer-owned intellectual property remain the property of their respective owners.
Nothing on this website grants permission to reproduce, distribute, modify, or commercially exploit protected material except as permitted by law or with authorization from the applicable rights holder.
13. Prohibited Uses
You may not use this website for unlawful or fraudulent activity, attempt unauthorized access to our systems, interfere with website operation or security, introduce malicious software, infringe intellectual-property rights, unlawfully collect information about others, or knowingly provide fraudulent or misleading information in connection with an order.
We reserve the right to take reasonable action against prohibited activity, subject to applicable law.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Fabubath will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of this website or the purchase, delivery, installation, or use of products where such damages may lawfully be excluded.
Nothing in these Terms excludes or limits liability, warranties, statutory remedies, or consumer rights that cannot legally be excluded or limited.
Any exclusion or limitation contained in these Terms applies only to the maximum extent permitted by applicable law.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold Fabubath harmless from third-party claims resulting from your unlawful misuse of our website, violation of these Terms, or infringement of another person's rights.
This provision does not limit consumer rights available under applicable law.
16. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible and the remaining provisions will remain in effect.
17. No Waiver
Fabubath's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
18. Entire Agreement
These Terms, together with Fabubath policies expressly incorporated into them, constitute the agreement governing use of our website and purchases made through it, except where a separate written agreement applies.
19. Changes to These Terms
Fabubath may update these Terms from time to time.
Updated Terms will apply prospectively after publication on our website. Changes will not retroactively alter the terms governing completed transactions where prohibited by applicable law.
20. Governing Law
These Terms and transactions with Fabubath are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable federal law or other non-waivable law provides otherwise.
Nothing in these Terms limits consumer protections or remedies that cannot legally be waived.
